Problem with Converging on version 5.1

I am working Comsol version 5.1 on a 3D Richards Equation problem. The scenario I am looking at is starting at saturated and draining through a pervious surface. My model is not converging in version 5.1 (but when it is run it in version 5.3 it does converge). Has anyone else countered this bug in 5.1 using a time dependent model with initial value p=0 model that isn't converging? Note: I need to continue using version 5.1 and thus just running the model in version 5.3 is not an option.
